Network Rail has initiated legal action against DB Cargo UK and Touax Rail, seeking over £5 million in damages following a significant fuel spill from a train derailment in August 2020. The incident, which involved the derailment of ten wagons, resulted in the spillage of 446,000 litres of fuel, leading to an evacuation of nearby residents and extensive environmental damage to protected wetlands.
The Rail Accident Investigation Branch attributed the derailment to inadequate maintenance, specifically a brake defect. The case highlights the ongoing repercussions of the incident, including a lengthy closure of the rail line and substantial recovery efforts, as Network Rail aims to hold the companies accountable for negligence and contractual breaches.
